Terms of Service
Last updated: June 6, 2026
These Terms of Service (“Terms”) govern your access to and use of Ghost Mic (the “Service”), a live fact-checking tool operated by Pair and Pivot, LLC (“we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. The Service
Ghost Mic listens to audio from your device's microphone during a conversation, transcribes it, and surfaces on-screen “cards” — fact-checks, context, charts, perspectives, and source links — generated with the help of third-party AI and search providers. You may also paste show notes in advance so the Service can research topics before you begin.
The Service displays information on your screen only. It does not speak, join your call, or record or publish anything on your behalf.
2. Beta service; changes and availability
The Service is currently offered free of charge and is under active development. It is provided on an “as is” and “as available” basis. We may add, change, suspend, or discontinue any part of the Service — including features and free access — at any time and without notice. We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free.
3. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, and able to form a binding contract to use the Service. By using the Service you represent that you meet these requirements.
4. Your responsibilities and acceptable use
You are solely responsible for how you use the Service and for the audio it processes for you. In particular, you agree that:
- Recording consent. Recording and transcription laws vary by location and many require the consent of everyone being recorded. You are responsible for obtaining any consent required from all participants before using the Service, and for complying with all applicable laws.
- Lawful content. You will not use the Service to process audio or content that is unlawful, infringing, or that you do not have the right to capture or submit.
- No misuse. You will not attempt to disrupt, reverse-engineer, overload, or gain unauthorized access to the Service or its underlying systems, or use it to violate the rights of others.
5. AI-generated content; no reliance
Cards are generated by automated AI systems and web search and may be incomplete, outdated, or wrong, including the hooks, summaries, figures, charts, and cited sources. The Service is a research aid, not a source of truth.
You are responsible for independently verifying any information before relying on it or repeating it publicly. Nothing the Service produces is legal, financial, medical, or other professional advice. We are not responsible for any decision you make, or anything you say or publish, based on a card.
6. Audio, transcripts, and your data
How we handle audio, transcripts, and other data is described in our Privacy Policy. In short: audio is processed in memory to produce a live transcript and is not stored on our servers, and any cards you save remain in your browser unless you choose to export them. To provide the Service, audio and text are transmitted to third-party providers as described below.
7. Third-party services
The Service relies on third-party providers for speech-to-text, AI inference, and web search (currently including Deepgram, Cerebras, and Google). Your use of the Service is also subject to those providers' terms, and we are not responsible for their services, availability, or outputs. We may change providers at any time.
8. Intellectual property
The Service, including its software, design, and branding, is owned by Pair and Pivot, LLC and protected by applicable law. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. You retain whatever rights you have in your own notes, audio, and saved cards.
9. Disclaimer of warranties
To the maximum extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service or any card is accurate, reliable, or complete.
10. Limitation of liability
To the maximum extent permitted by law, Pair and Pivot, LLC and its members, officers, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or reputation, arising out of or related to your use of (or inability to use) the Service or any card it produces. Because the Service is provided free of charge, our total aggregate liability for all claims relating to the Service will not exceed one hundred U.S. dollars (US$100).
11. Indemnification
You agree to indemnify and hold harmless Pair and Pivot, LLC from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your content, or your violation of these Terms or of any law or third-party right — including any claim related to recording or transcribing another person without required consent.
12. Termination
You may stop using the Service at any time. We may suspend or terminate your access at any time, with or without notice, including if we believe you have violated these Terms. Provisions that by their nature should survive termination will survive.
13. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
14. International users
We operate the Service from the United States and make it available worldwide. If you access the Service from outside the United States, you do so on your own initiative and are responsible for compliance with local law. Nothing in these Terms limits any non-waivable rights or protections you have under the mandatory consumer or data-protection laws of your country or region (for example, the EU/UK GDPR or applicable US state privacy laws) — where those laws apply, they prevail over any conflicting provision here to the extent of the conflict.
15. Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules, and the courts located in Delaware will have jurisdiction over any dispute — except that this does not deprive you of the protection of mandatory provisions of the law of your country of residence, and consumers may bring claims in the courts of their home jurisdiction where local law so requires.
